What is a guardian advocate?

Under Florida law, a guardian advocate may sometimes be appointed as an alternative to full guardianship. This less restrictive option is only available for adults with specific developmental disorders, such as Down Syndrome or autism. It does not require the ward to be declared incapacitated, so the process may be easier than seeking full guardianship.

Florida defines incapacity as an adult lacking the necessary capacity to manage at least some of their own property, or to provide for their own health and safety. The court makes this determination after appointing a committee of experts to examine the evidence.
